Terms of Service

Effective date: 2 June 2026

These Terms of Service govern your access to and use of the Paysation website, platform, APIs, dashboards, documentation, business communications and related services, unless a separate written agreement applies.

By accessing or using the Paysation website, platform or services on behalf of an organization, you represent that you have authority to act for and bind that organization.

If you do not agree to these Terms of Service, you must stop accessing and using the website, platform and services.

Definitions

“Paysation”, “we”, “our” and “us” refer to Paysation Limited, a company registered in Ireland with its address at 19 Baggot Street Lower, Dublin, D02 X658, Ireland.

“You”, “your” and “yours” refer to any user of the Paysation website, Paysation Platform or Paysation Services, including any person acting on behalf of a company, merchant, partner or other organization.

“Paysation Platform” means internet-based software, APIs, dashboards, merchant interfaces, documentation and other technologies made available by Paysation.

“Paysation Services” means payment infrastructure and related services provided by Paysation, including payment gateway services, acquiring support, payment orchestration, payment routing, recurring payment support, risk controls, fraud-prevention workflows, alerting, reporting and operational tools.

“Paysation Website” means https://paysation.com and its pages, content and subdomains.

“Merchant” means an organization that uses, evaluates or seeks to use Paysation Services.

“End-user” means an individual who purchases goods or services from a merchant or otherwise interacts with a merchant payment flow.

“Paysation Parties” means Paysation, its affiliates, subsidiaries, directors, officers, employees, contractors, agents, service providers and shareholders.

Paysation services

Paysation provides payment infrastructure and related technology services for business customers. These services may include payment gateway functionality, acquiring support, payment orchestration, payment routing, recurring payment support, open banking or alternative payment method support, risk controls, fraud-prevention workflows, alerting, reporting and merchant operational tools.

Paysation may provide APIs, SDKs, hosted payment interfaces, dashboards, documentation and other technologies to enable merchants and partners to access and implement Paysation Services.

Access to any commercial service, technical integration, merchant account, processing capability or payment solution may be subject to separate agreements, onboarding, due diligence, compliance checks, technical approval, partner approval and applicable legal, regulatory, payment network and scheme requirements.

Descriptions of services on the Paysation Website are for general business information purposes and do not guarantee availability, approval, performance, results or continued operation for any specific business, market, jurisdiction or use case.

Acceptance of these terms

You agree to these Terms of Service by accessing or using the Paysation Website, Paysation Platform or Paysation Services.

If you are acting on behalf of an organization, you confirm that you are authorized to accept these terms on behalf of that organization.

Where a separate written agreement exists between Paysation and your organization, that agreement will govern the applicable commercial services. These Terms of Service will continue to apply to website use and to the extent they are not inconsistent with the separate agreement.

Allowed use of the website and platform

You may use the Paysation Website and Paysation Platform only for lawful business purposes and in accordance with these Terms of Service, applicable agreements, documentation, policies and laws.

Subject to your compliance with these Terms of Service and any applicable agreement, Paysation grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the website, platform and related content for business information, evaluation, integration or service use purposes.

You must not use, copy, modify, adapt, distribute, transmit, translate, display, reverse engineer, scrape, resell or otherwise exploit the Paysation Website, Paysation Platform, APIs, documentation or content without prior written permission from Paysation, except where expressly permitted by applicable law or a written agreement.

You must not remove, obscure or alter any copyright notice, trademark notice or proprietary rights notice contained in or accessed through the Paysation Website, Paysation Platform or documentation.

Paysation reserves all rights not expressly granted in these Terms of Service or in a separate written agreement.

Business enquiries and submitted information

If you submit information through the website, by email, through a form, in a meeting, during onboarding or through another communication channel, you must ensure that the information is accurate, complete and not misleading.

You are responsible for obtaining any internal approvals, third-party permissions, data protection notices, consents or other legal bases required before submitting information to Paysation.

Submitting an enquiry, request, form, document or business information does not create a client relationship, merchant account, processing relationship, partnership, approval, integration commitment or obligation for Paysation to provide services.

Paysation may rely on information you provide when evaluating enquiries, preparing proposals, performing onboarding, conducting risk review, preparing agreements, providing support or assessing service availability.

Merchant onboarding and service availability

Any potential use of Paysation Services may require business review, merchant due diligence, identity and authority checks, KYC, KYB, AML, sanctions screening, risk assessment, technical assessment, contractual approval and ongoing compliance review.

Paysation may request information, documentation and confirmations to support compliance, risk review, underwriting, monitoring, reporting, technical setup, dispute handling, payment operations or partner requirements.

Paysation may decline, suspend or discontinue discussions, onboarding, integration or service availability where required by law, regulation, payment network rules, partner requirements, risk controls, compliance standards, business policies, security concerns or operational considerations.

Availability of payment methods, acquiring connections, currencies, countries, settlement flows, recurring functionality, open banking capabilities, risk tools, reporting features or other services may vary by jurisdiction, business type, partner, integration model and applicable approval requirements.

No payment data through public website forms

The Paysation Website is an informational and business contact website. It is not intended to collect payment card data from website visitors.

You must not submit card numbers, authentication credentials, sensitive payment data, bank login credentials or other highly sensitive financial information through public website forms, general email or unsecured channels unless a secure channel has been specifically provided and authorized for that purpose.

Where payment processing services are provided, handling of payment data is governed by the relevant service agreements, technical integrations, security requirements and applicable payment industry rules.

Data protection

Use of the Paysation Website, Paysation Platform and Paysation Services may involve processing of personal data. Our processing of personal data is described in our Privacy Notice and Cookie Policy.

Where Paysation provides services to a merchant or partner and processes personal data on behalf of that organization, Paysation may act as a data processor or service provider, and the merchant or partner may act as data controller.

Where you or your organization acts as data controller, you are responsible for complying with applicable data protection laws, providing appropriate privacy notices, obtaining any required consents or other legal bases, responding to data subject requests and ensuring that personal data transferred to Paysation is lawful, accurate and relevant.

When Paysation acts as a processor, we process personal data according to the applicable agreement, documented instructions, Data Processing Agreement, technical documentation and applicable law.

In some cases, where payment pages, hosted interfaces, technical integrations or specific service configurations are used, the allocation of data protection responsibilities may be addressed in a separate agreement.

Paysation uses technical and organizational measures designed to protect personal data and will handle personal data incidents according to applicable law and contractual obligations.

Security, viruses and misuse

We do not guarantee that the Paysation Website, platform, APIs, files, links or content will be free from viruses, bugs, vulnerabilities or harmful components.

You are responsible for your own information technology configuration, devices, systems, software, network security and virus protection when accessing the Paysation Website or Paysation Platform.

You must not introduce viruses, trojans, worms, logic bombs, malware, spyware, harmful code or other material that could damage, disrupt, impair or compromise the Paysation Website, Paysation Platform, APIs, servers, databases, systems, networks or users.

You must not attempt unauthorized access to the website, platform, APIs, servers, databases, accounts, source code, non-public information, technical infrastructure or any connected systems.

You must not perform denial-of-service attacks, distributed denial-of-service attacks, abusive scanning, probing, scraping, automated requests or other activity that may harm, overload or impair Paysation systems or services.

Paysation is not liable for loss or damage caused by viruses, attacks or other technologically harmful material resulting from your access to or use of the website, platform or linked resources, except where such liability cannot be excluded by law.

Account and credential responsibility

If you receive access to any Paysation account, dashboard, merchant portal, API, integration credential, sandbox, production environment or other restricted interface, you are responsible for maintaining the confidentiality and security of that access.

You must use strong passwords, protect credentials and API keys, restrict access to authorized users, maintain appropriate internal access controls and promptly notify Paysation if you suspect unauthorized access or compromise.

You are responsible for activity conducted through your account, credentials, API keys or authorized users, subject to the applicable agreement and law.

Paysation may suspend or restrict access where we reasonably believe that credentials have been compromised, access is unauthorized, security is at risk, or continued access may harm Paysation, merchants, partners, End-users or third parties.

Intellectual property rights

The Paysation Website, Paysation Platform, APIs, documentation, text, graphics, logos, icons, images, software, code, structure, user interface, designs, trademarks, service marks, trade names and other materials are owned by or licensed to Paysation and are protected by intellectual property laws.

You acknowledge that you do not acquire any ownership right, title or interest in the Paysation Website, Paysation Platform, APIs, documentation or content by accessing or using them.

You must not reproduce, store, copy, share, distribute, modify, publish, sell, license, reverse engineer, create derivative works from or commercially exploit any part of the website, platform, APIs, documentation or content without prior written permission from Paysation, except where permitted by applicable law or a written agreement.

Paysation and its licensors reserve all rights not expressly granted.

Trademarks

The Paysation name, logos, product names, service names, marks, graphics, icons and brand elements are trademarks, service marks or trade dress of Paysation or its licensors.

Other names, logos, marks and brand elements displayed on or through the website may be the property of their respective owners.

You must not use any Paysation trademark, service mark, trade dress, logo, brand element, meta tag or hidden text without prior written permission from Paysation.

Nothing on the website grants any license or right to use any Paysation trademark or third-party mark.

Information on the website

Website content is provided for general business information purposes only. It should not be treated as legal, financial, technical, compliance, tax, accounting or professional advice.

You should not rely on website information alone for business, legal, compliance, integration, processing, risk or operational decisions. You should consult qualified professionals and request written confirmation from Paysation where specific advice, contractual commitments or technical requirements are needed.

Any forward-looking, illustrative, technical or descriptive statements on the website are based on current assumptions and may be subject to uncertainties, changes, partner requirements, legal requirements, operational conditions and events beyond our control.

You access and use the website and its content at your own discretion and risk.

Privacy notice and cookies

Use of the Paysation Website, Platform and Services is also governed by our Privacy Notice and Cookie Policy, which are incorporated into these Terms of Service by reference where applicable.

The Privacy Notice explains how Paysation collects, uses, stores, shares and protects personal data.

The Cookie Policy explains how Paysation uses cookies and similar technologies.

By using the website, platform or services, you acknowledge that these policies apply to your use of the website, platform and services.

Disclaimer

The Paysation Website, Paysation Platform, APIs, documentation and content are provided on an “as is” and “as available” basis.

To the maximum extent permitted by applicable law, Paysation disclaims all warranties, representations and conditions, whether express, implied, statutory or otherwise, including warranties of accuracy, availability, performance, merchantability, fitness for a particular purpose, non-infringement, security, reliability, timeliness and completeness.

We do not guarantee that the website, platform, APIs, documentation, products or services will be uninterrupted, error-free, secure, available in every location, suitable for every business, approved for every merchant or kept up to date at all times.

Some jurisdictions do not allow the exclusion of certain warranties. In such cases, the exclusions apply to the maximum extent permitted by applicable law.

Limitation of liability

Nothing in these Terms of Service excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot be excluded or limited under applicable law.

To the maximum extent permitted by applicable law, Paysation Parties will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, business, goodwill, reputation, opportunity or anticipated savings arising out of or in connection with use of the website, platform, services, APIs, documentation or content.

These limitations apply whether the claim is based on contract, tort, negligence, warranty, statute or any other legal theory, and whether or not Paysation has been advised of the possibility of such damages.

Where liability cannot be excluded but may be limited, Paysation’s aggregate liability will be limited to the maximum extent permitted by applicable law and any applicable written agreement.

Prohibited activities and suspension

Paysation may restrict, suspend, decline or terminate access to the website, platform, APIs, services or onboarding where activity is unlawful, fraudulent, deceptive, harmful, abusive, high-risk, unsupported or otherwise inconsistent with Paysation policies, partner requirements, payment network rules, applicable law or risk controls.

Prohibited activities include:

  • fraud, money laundering, terrorist financing, sanctions evasion or other illegal activity;
  • misrepresentation of business identity, ownership, products, services, pricing, terms or customer relationships;
  • attempting to bypass compliance, risk, security, underwriting, monitoring or payment controls;
  • submitting false, incomplete or misleading information;
  • infringing intellectual property, privacy, data protection, consumer or third-party rights;
  • interfering with the website, platform, APIs, systems, infrastructure, security controls or third-party services;
  • distributing malware, spam, phishing, harmful code or unauthorized solicitations;
  • using Paysation systems for activities prohibited by applicable law, payment network rules, partner requirements or Paysation policies.

Paysation may take action without prior notice where necessary to protect security, comply with law, prevent fraud, manage risk, protect third parties or preserve service integrity.

Indemnification

You agree to defend, indemnify and hold harmless Paysation Parties from and against claims, demands, losses, liabilities, damages, costs and expenses arising out of or relating to your misuse of the website, platform, APIs or services; your breach of these Terms of Service; your violation of law; your infringement of third-party rights; your submission of inaccurate, unlawful or misleading information; or activity conducted through your account, credentials, integration or authorized users.

Paysation may assume control of the defense of any matter subject to indemnification. You must cooperate with Paysation in the defense of such claims.

Changes to these Terms of Service

Paysation may update these Terms of Service from time to time by publishing a revised version on the website.

The updated version will be effective from the date stated on this page unless a different date is specified.

If you use the Paysation Platform or Paysation Services, Paysation may provide notice of material changes where required by law or contract.

Continued use of the website, platform or services after changes are published means that you accept the updated Terms of Service.

Governing law and disputes

These Terms of Service are governed by the laws of Ireland, without regard to conflict of law rules.

The courts of Ireland shall have jurisdiction over disputes arising out of or in connection with these Terms of Service or use of the website, platform or services, subject to any mandatory rights or rules that apply under applicable law.

Nothing in these Terms of Service prevents Paysation from seeking injunctive, equitable or similar relief in any competent jurisdiction where necessary to protect its rights, systems, confidential information, intellectual property or services.

Miscellaneous

No waiver. Failure or delay by Paysation to exercise or enforce any right, power or remedy under these Terms of Service does not constitute a waiver of that right, power or remedy.

Severability. If any provision of these Terms of Service is found to be invalid, illegal or unenforceable, the remaining provisions will continue in full force and effect.

Force majeure. Paysation will not be liable for delay or failure to perform caused by events or conditions beyond its reasonable control, including network failures, hosting failures, labor disputes, war, terrorism, civil unrest, natural disasters, government action, supplier failure, payment network issues or other force majeure events.

Assignment. You may not assign, transfer, novate or subcontract your rights or obligations under these Terms of Service without prior written permission from Paysation. Paysation may assign or transfer its rights and obligations where permitted by law and applicable agreement.

Entire terms. These Terms of Service, together with any policies or documents incorporated by reference, form the terms governing website use unless a separate written agreement applies.
